CALIFORNIA STATE DEPARTMENT OF CORRECTIONS NOTIFICATION TO THE DEPARTMENT OF CHILDREN AND FAMILY SERVICES

The purpose of this release is to inform staff of the requirements of Penal Code Section 3058.4. This section requires parole officers to report to the child protective agency any person paroled following conviction of specified child abuse offenses or any sex offense identified in statutory law as being perpetrated against a minor victim when (s)he has violated a term or condition of parole restricting contact with the victim or the victim’s family for any of the following offenses:

    • abusing or endangering the health of a child;
    • assault of a child with force likely to produce great bodily injury resulting in death;
    • felony to inflict corporal injury upon a child; enhancement for prior conviction; or
    • any sex offenses identified as perpetrated against a minor with a condition of parole specifically restricting contact with the victim of the offense or the victim’s family.

These notifications may include open or closed DCFS cases or families that do not have a current or prior case with our Department. These children may or may not be in danger. It is anticipated that the majority of these notifications will not generate an accepted referral. However, a Child Abuse Hot Line CSW will evaluate the calls to determine the appropriate disposition.

Any staff receiving a call from the Department of Corrections should refer the caller to the Child Abuse Hot Line at 1-800–540-4000 and request that (s)he select the recording option "Consultation Line" when placing the call.
